What is a settlement agreement?
A settlement agreement, previously known as a compromise agreement, is a legally binding contract that employers use to set out terms and conditions, agreed upon by an employee. A settlement agreement is usually associated with the termination of an employment, but sometimes it will be used to settle a dispute that has arisen, without necessarily ending the employment. Once you have decided upon a settlement agreement, you will almost always waive your right to bring any claims against your employer.
A settlement agreement is legally binding, so it is extremely important that it is properly drafted, and properly explained to you. The law says that an agreement is only valid if you have taken independent legal advice on the terms and the effects of the settlement agreement, before signing it.
